1. Tour Operator:
Vicmoto Motorcycle Tours Pty Ltd is owned and operated by Steven Craig and
Martin Craig.

2. Minimum Age: The minimum age for tour participants
is 18 years of age.
3. Tour Bookings and Payment:
-
Tour bookings can be made
on line, by email, by telephone, by facsimile or in person as described on
the Vicmoto Motorcycle Tours website and advertising brochure.

Payment is required in full
prior to commencement of the tour and can be made by cash or credit card (Mastercard
& Visa). Personal cheques are
not acceptable.

After booking confirmation,
which involves acknowledgement of this fact by Vicmoto Motorcycle Tours and
tour participant(s), then the booking is binding. Vicmoto Motorcycle Tours
reserves the right to consider a booking cancelled.
4. Tour Prices:
-
Tour prices do not include
the cost of courier charges in any form, medical insurance, overnight
accommodation, additional hotel charges, telephone calls, drinks snacks and
meals for tour participants unless specifically stated at the time of
booking by the tour operators.

Tour prices are shown on
the Vicmoto Motorcycle Tours website and advertising brochure.
5. Tour Options and Features:
-
These are described in
brief overview on the ‘City Tours’, 'Half Day Tours', ‘One Day Tours’, ‘Two
Day Tours’ and ‘Ultimate Tours’ pages of the Vicmoto Motorcycle Tours website and/or the
advertising brochure.

Vicmoto Motorcycle Tours
reserves the right to modify tours without notice to allow for changes in
local road conditions due to road works, landslips, forest fires and road
closures due to accidents etc.
6. Cancellations & Refunds:
-
If a tour has to be
cancelled by your tour operator due to extreme unforeseen weather conditions
or equipment failure the tour will re-scheduled on a mutually agreeable
alternative date, if this option is impossible for tour participant(s) then
the cost of the tour will be refunded in full.

If a booked and confirmed
tour is cancelled by the tour participant(s) then a forfeit fee of $150.00
per person applies. If tour participants fail to appear on the day of the
tour at the designated and agreed meeting point for the start of the tour,
there will be no refund and the full cost of the tour is the forfeit fee.
7. Personal Data:

Any personal data provided
to Vicmoto Motorcycle Tours by tour participants is obtained solely for the
purposes of booking and payment of tours.

All data is stored
remotely and securely and will not be distributed or sold to any third
party by Vicmoto Motorcycle Tours.
8. Promotional Material:
-
Tour participants shall be
aware that Vicmoto Motorcycle Tours takes photographs and video images of
tour participants depicting their interaction with other tour members and
motorcycles during tours.

These images are
obtained by the tour operator’s efforts and equipment, and remain the
property of Vicmoto Motorcycle Tours. Copyright resides with Vicmoto
Motorcycle Tours.
-
These images may be
used for future advertising brochures, advertising layouts, slide
shows, website content, marketing, magazine articles and other
promotional uses.
9. Responsibilities & Liability:
-
Vicmoto Motorcycle Tours is
responsible for ensuring that motorcycles and safety equipment are
maintained in a safe and serviceable condition to ensure operation in
accordance with manufacturers’ specifications.
-
Vicmoto Motorcycle Tours is
not responsible or liable for any expenses incurred: As a result of missed
subsequent travel connections; due to any delays, foreseen and unforeseen;
as a result of any changes to schedules to accommodate unplanned events;
theft of personal property or any other conditions beyond our control.

Vicmoto Motorcycle Tours
riders are responsible for exercising a reasonable standard of care whilst
operating motorcycles carrying passengers in terms of riding in a safe,
responsible and legal manner.

Vicmoto Motorcycle Tours is
not liable for the aggravation of any underlying medical conditions due to
mounting/dismounting the motorcycles, being carried on the motorcycles as a
passenger or the wearing of any of the supplied safety equipment.
-
Vicmoto Motorcycle Tours is
not responsible or liable for any accidents and /or bodily injury or death
resulting from any activity undertaken by tour participants whilst
sightseeing, eating and resting during tours and whilst touring on
motorcycles. Tour participants, their heirs, successors and assigns,
absolve Vicmoto Motorcycle Tours and its operators from any and all
liability or claims directly or indirectly related to participation on a
tour.
10. Riders and Passengers:
-
Both riders and passengers
should be aware at all times that traffic, road and weather conditions can
increase the risks associated with travelling by motorcycle.
-
Both riders and passengers
shall understand and fully accept those risks and are responsible for
behaving in a sensible manner that mitigates those risks.
-
Passengers shall at all
times adhere to the points highlighted in the pre-tour safety briefing.
-
A moderate standard of
fitness is required of all passengers and the ability to mount and dismount
the motorcycle unaided in a manner that does not endanger the safety of the
passenger or the rider is essential. A tour cannot commence if this
condition is not met.

Vicmoto Motorcycle Tours
reserves the right to refuse to carry any person whose behaviour on a
motorcycle threatens the safety of themselves, the motorcycle rider and/or
other road users.
11. Consumption of Alcohol or Drugs:
-
Tour participants shall not
consume alcohol, illicit or prescription drugs (which adversely affect
mental or physical coherence and coordination) during the course of a tour.
Vicmoto Motorcycle Tour operators reserve the right at any time not
to carry any person who in their opinion is unable to safely be a passenger
on a motorcycle due to the consumption of alcohol or drugs.

This also applies on
overnight tours and tour participants should limit alcohol intake during
evenings that are to be followed by motorcycle travel on the next day.

Vicmoto Motorcycle Tours
reserves the right to cancel a tour, or the remainder of a tour, in such
circumstances without refund of the tour fee.

Tour participants may
purchase bottles of wine on winery tours and they can be transported
unopened in the motorcycle luggage compartments.
12. Safety Briefing:
-
Tour participants shall
receive assistance regarding the wearing and fitting of all safety equipment
prior to the commencement of the tour.
-
The wearing of all
items of safety equipment is a mandatory requirement. Refusal to wear or
inadequate fitting of safety equipment will result in the tour being
cancelled.
-
Tour participants shall
also receive a safety briefing that covers mounting and dismounting the
motorcycle and what is expected of them whilst travelling as passenger on a
motorcycle.
13. Acceptance of Terms & Conditions:
-
Tour participants are
required to sign a copy of these Terms & Conditions immediately prior to a
tour commencing and must be witnessed by the tour operators. Identification
of participants must be verified to the satisfaction of the tour operators
at this time.

Signatories acknowledge
acceptance of all the above Terms & Conditions.

above terms and conditions. I acknowledge that there are risks associated
with travelling on a motorcycle, which have been explained to me, and I
and have been given a full verbal safety briefing prior to the commencement of
the tour.
